Terms of Service

Welcome to Pingr. These Terms are a legal agreement between you and EFN Group LLC ("we," "us") governing your use of the Pingr app and related services ("the Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service. For apps installed from the Apple App Store, these Terms also incorporate Apple's standard Licensed Application End User License Agreement (LAEULA); where they conflict, these Terms control to the extent permitted.

01 · The Service

Pingr is a restock-alert tool for trading-card products. We notify you when tracked products come back in stock at major retailers and link you to the retailer's own page so you can buy directly from them. We never purchase, reserve, add to cart, or check out for you — the Service only sends alerts and opens the retailer's website. Availability information is provided on a best-effort basis and may be delayed, incomplete, or inaccurate.

02 · Eligibility & accounts

You must be at least 13 years old to use the Service. You are responsible for your account credentials and for activity that occurs under your account. Provide accurate information and keep it up to date. You may delete your account at any time in Settings → Delete Account.

03 · Subscriptions & billing

Pingr is offered as a single all-access subscription — $14.99/month or $44.99/year, at the prices shown in the App Store or Google Play at the time of purchase. There is no free tier and no trial. Subscriptions are sold through the App Store and Google Play; payment is charged to your store account at confirmation of purchase.

Subscriptions auto-renew unless turned off at least 24 hours before the end of the current period. Manage or cancel anytime in your device's subscription settings (e.g. iOS Settings → your Apple Account → Subscriptions). Deleting the app or your Pingr account does not cancel a subscription. Use Restore Purchases if you reinstall or switch devices. Except where required by law, payments are non-refundable; refund requests for store purchases are handled by Apple or Google under their policies.

04 · Acceptable use

Use the Service for your own personal, lawful purposes. You agree not to resell, scrape, or redistribute the feed; not to use automated systems to overload or abuse the Service; not to circumvent the subscription paywall or our entitlement controls; not to reverse engineer or attempt to extract source code or non-public data except where that restriction is prohibited by law; and not to use the Service to violate any retailer's terms or any applicable law. Pingr does not facilitate automated purchasing or "botting" of any kind.

05 · Third-party retailers

The Service links to third-party retailer websites. Your purchases are transactions solely between you and the retailer, governed by the retailer's own terms, pricing, availability, and policies. We are not a party to those transactions and are not responsible for products, prices, order limits, cancellations, or fulfillment.

06 · Intellectual property & non-affiliation

Pingr is an independent app and is not affiliated with, sponsored by, or endorsed by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK, Apple, or any retailer. All product names, logos, trademarks, and brands are the property of their respective owners and are used for identification purposes only. The Pingr name, app, and content are owned by us and protected by applicable law; we grant you a limited, personal, non-transferable, revocable license to use the app on devices you own or control.

07 · Disclaimers

The Service is provided "as is" and "as available." We do not guarantee that any alert will be timely, accurate, or that any product will be available or purchasable. Restock alerts are informational only — you are responsible for verifying availability and completing any purchase on the retailer's site. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

08 · Limitation of liability

To the maximum extent permitted by law, EFN Group LLC and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any missed purchase, lost opportunity, or amounts paid to third-party retailers, arising out of or relating to your use of the Service. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

09 · Indemnification

You agree to indemnify and hold harmless EFN Group LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

10 · Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others, the retailers, or us.

11 · Apple App Store

If you downloaded Pingr from the Apple App Store, the following also apply: these Terms are between you and EFN Group LLC only, not Apple, and Apple is not responsible for the app or its content. Your license is limited to use on Apple-branded products you own or control, as permitted by the App Store Usage Rules (including Family Sharing where applicable). Apple has no obligation to provide maintenance or support. Apple has no warranty obligation; if the app fails to conform to any applicable warranty you may notify Apple, and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation. EFN Group LLC, not Apple, is responsible for addressing any product-liability, legal/regulatory-conformance, and third-party intellectual-property claims relating to the app. You represent that you are not located in a U.S.-embargoed country and are not on any U.S. Government prohibited-or-restricted-parties list. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12 · Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply.

13 · Changes to these Terms

We may update these Terms from time to time. We'll post the new effective date here and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
